The Illusion of Enterprise Safety: Why Sanctioned LLM Accounts Still Leak Patient Data

When a hospital buys an enterprise LLM license and a Business Associate Agreement (BAA), boards breathe easier. It feels like a checkbox: licensed vendor, signed DPA/BAA, we’re covered.
That comfort is useful; enterprise offerings add authentication, retention controls, and contractual obligations. But they don’t stop clinicians from copying a patient summary into a conversational field, or a researcher from pasting a dataset into a public model during a late-night experiment. Those prompt-level actions create new egress vectors that traditional perimeters and EHR audit logs were never designed to see. The result: sanctioned accounts, sanctioned vendors, and yet, a leak that looks indistinguishable from a classic data breach until it’s too late.
Enterprise Tooling Closes Many Gaps: Use Them Well
Enterprise LLM offerings are a meaningful step forward. Vendors now provide healthcare-focused suites, dedicated workspaces, BAAs, and configurable data-retention policies that consumer products lack. These capabilities let hospitals centralize sanctioned use, control model access, and reduce some classes of accidental exposure. For teams that replace ad-hoc chat use with an approved workspace, benefits are immediate: fewer shadow integrations, centralized model governance, and contractual levers.
Second, enterprise stacks make it easier to standardize models and validation workflows. When a clinical AI is deployed through a sanctioned pipeline, you can attach validation checks, logging, and role-based access, all things auditors and insurers appreciate. Those controls matter when regulators or acquirers ask for evidence of due diligence. Bottom line: licensing is necessary, not sufficient. Use it as part of a layered defense, not the whole castle.
Signed Contracts Don’t Stop Human Paste or Prompt Attacks
Here’s the catch: enterprise controls live at the vendor boundary. They don’t see what users type. A clinician can still paste PHI into a conversation field, a billing clerk can feed identifiers into a bulk prompt, and a curious researcher can chain prompts that leak aggregated records. Those actions bypass file-based DLP and traditional perimeter detections because the sensitive content is now an input token sequence, not a transferred file or obvious outbound blob. IBM’s data shows ungoverned AI and shadow flows are expensive, roughly $670k extra per breach on average, largely because detection is slower and the exposed scope is larger.
Prompt injection complicates things further. The UK NCSC and multiple security teams flag prompt attacks as structurally different from classic bugs: LLMs do not distinguish code from data, so malicious or accidental prompt content can alter behavior and produce exfiltration without any network signature traditional IDS/IPS would flag. In short: BAAs and enterprise licensing reduce vendor risk, but they don’t remove the need for client-side, runtime, prompt-aware controls.
My Perspective: Treat LLMs Like Endpoints
If you’re a CISO or a CTO in healthcare, reframe the problem this way: the attack surface now includes what people say to the model. That means the behavioral boundary you must control sits inside the user-to-model channel. Contracts, retention settings, and API terms only address half the problem; the other half is operational: prevent PHI from leaving before it hits the cloud, and record everything before it’s accepted as transient model context.
Practical steps I’d push for right now: client-side redaction (automatic PII scrubbing inside EHR UI/browser plugins), enforced egress through a vetted gateway (only approved model calls, with token-level inspection), prompt-firewalling that blocks or rewrites risky inputs, and immutable telemetry that captures prompt metadata for audits. This is how you turn a contractual safety net into actionable safety.
Finally, don’t conflate vendor assurances with organizational maturity. A BAA helps in court; runtime detection saves patients and lowers remediation costs. Boards will sign off on vendor programs. But get them to sign off on the engineering work too, prompt telemetry, prompt controls, and the incident playbook that runs when a prompt path goes wrong.
